Scope of Services
Services are defined by a written proposal, invoice description, support plan, subscription page, or project agreement approved by the client. Work outside the agreed scope may require a separate quote or change request.
These Terms of Service apply to websites, custom software, productized digital services, support plans, and related implementation work provided by Zinduka Digital Solutions Ltd.
Services are defined by a written proposal, invoice description, support plan, subscription page, or project agreement approved by the client. Work outside the agreed scope may require a separate quote or change request.
Payments may be collected as project deposits, milestone invoices, monthly subscriptions, or support retainers. Services may begin only after the applicable payment has been confirmed, unless otherwise agreed in writing.
Where a recurring plan is offered, subscriptions renew according to the selected billing cycle unless canceled before the next renewal date. Access to hosted services or support benefits may be paused or discontinued if payment is not successfully completed.
Delivery dates are estimates unless specifically guaranteed in writing. Timelines depend on timely client feedback, access credentials, required materials, and third-party service availability.
Clients are responsible for providing accurate requirements, lawful content, necessary approvals, and any materials or access credentials needed to perform the work. The client must ensure that their use of delivered materials complies with applicable laws.
Unless otherwise specified in an agreement, ownership of final deliverables transfers according to the applicable project terms after full payment is received. Pre-existing tools, frameworks, templates, and internal methods remain the property of Zinduka Digital Solutions Ltd. or their respective owners.
Our services may rely on third-party hosting providers, software libraries, communication tools, analytics services, domain registrars, payment providers, and other external systems. We are not responsible for outages, policy changes, pricing changes, or service restrictions imposed by those third parties.
Post-delivery support is provided according to the purchased plan, agreement, or maintenance package. Unused support time does not automatically roll over unless explicitly stated.
Refunds are handled according to our published Refund Policy, the stage of work completed, and any written agreement between the parties. Clients should review the Refund Policy before purchasing services or subscriptions.
To the maximum extent permitted by law, Zinduka Digital Solutions Ltd. is not liable for indirect, incidental, special, or consequential losses, including lost profits, lost business opportunities, or interruptions caused by third-party systems, client-side issues, or events outside our reasonable control.
Either party may terminate an engagement if the other materially breaches the agreed terms or if continuing the engagement becomes impossible for operational, legal, or compliance reasons. Work already completed remains payable.
We may refuse or terminate services involving illegal content, infringement of intellectual property rights, deceptive practices, prohibited platform activity, harmful software use, or other requests that create legal, ethical, or compliance risks.
